Terms & Conditions

These Terms and Conditions ("Terms") govern the relationship between StaffAsset Recruitments ("StaffAsset®", "we", "us") and any employer, client, candidate or website user ("you"). By using our services or website, you agree to these Terms.

1. Definitions

• "Candidate" — an individual registered with StaffAsset® seeking temporary or permanent employment
• "Client/Employer" — an organisation engaging StaffAsset® to supply workers or permanent staff
• "Assignment" — a period during which a Candidate works for a Client
• "Engagement" — any direct or indirect employment or contract between Client and Candidate
• "Introduction" — when we present a Candidate's details to a Client

2. Our Services

StaffAsset® provides temporary staffing, permanent recruitment, and associated consultancy services across the Healthcare, Social Care, Education and SEN sectors. We act as an employment business (for temporary workers) and an employment agency (for permanent placements) as defined by the Employment Agencies Act 1973.

3. Employer Terms

3.1 Obligations

• Provide accurate job specifications, working conditions and applicable rates of pay
• Comply with all relevant employment legislation including the Working Time Regulations 1998
• Notify us immediately of any concerns regarding a Candidate's conduct or performance
• Not engage a Candidate introduced by us without payment of the applicable fee or charge

3.2 Transfer Fees

If a Client directly engages a Candidate within 12 months of introduction by StaffAsset®, a transfer fee is payable as per our current fee schedule. This applies whether the engagement is as an employee, contractor or through a third-party agency.

4. Candidate Terms

• You confirm all information provided is accurate, current and complete
• You consent to us sharing your details with prospective employers
• You hold all required professional registrations (NMC, HCPC, SWE etc.) and will notify us of any changes
• You agree to DBS and Right to Work checks as required
• You will not accept engagements from clients introduced by us without informing us
• You understand we cannot guarantee placement

5. Fees & Payment

5.1 Temporary Staffing

Fees for temporary assignments are calculated on agreed hourly or daily rates plus applicable employer's National Insurance and holiday pay. Invoices are issued weekly and payable within 14 days.

5.2 Permanent Placements

Permanent placement fees are calculated as a percentage of the candidate's first-year gross salary, as agreed in writing before commencement of the search.

5.3 Late Payment

We reserve the right to charge interest on overdue invoices at 8% above the Bank of England base rate under the Late Payment of Commercial Debts (Interest) Act 1998.

6. Confidentiality

Both parties agree to keep confidential any sensitive information disclosed during the course of the relationship. Candidate details shared with employers are for recruitment purposes only and must not be passed to third parties without consent.

7. Liability

StaffAsset® takes reasonable steps to verify candidate qualifications and compliance documentation. However, we cannot guarantee the suitability of any Candidate and our liability for any loss arising from a placement is limited to the fees paid for that specific placement.

We are not liable for any indirect, consequential or special loss, including loss of profit or reputation.

8. Compliance Obligations

We are committed to compliance with all applicable legislation including:

• Employment Agencies Act 1973 and Conduct of Employment Agencies and Employment Businesses Regulations 2003
• UK GDPR and Data Protection Act 2018
• Equality Act 2010
• National Minimum Wage Act 1998
• Modern Slavery Act 2015
• Health and Safety at Work Act 1974

9. Intellectual Property

All content on the StaffAsset® website — including text, graphics, logos and design — is the property of StaffAsset Recruitments and protected by copyright. You may not reproduce any content without prior written consent.

10. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
